The Accidental Republic: Crippled Workingmen, Destitute Widows, and the Remaking of American Law by John Fabian Witt,
In the five decades after the Civil War, the United States witnessed a profusion of legal institutions designed to cope with the nation's exceptionally acute industrial accident crisis. Jurists elaborated the common law of torts. Workingmen's organizations founded a widespread system of cooperative insurance. Leading employers instituted welfare-capitalist accident relief funds. And social reformers advocated compulsory insurance such as workmen's compensation. John Fabian Witt argues that experiments in accident law at the turn of the twentieth century arose out of competing views of the loose network of ideas accident experiment and institutions that historians call the ideology of free labor. These experiments a century ago shaped twentieth- accident experiment and twenty-first-century American accident law; they laid the foundations of the American administrative state; accident experiment and they occasioned a still hotly contested legal transformation from the principles of free labor to the categories of insurance accident experiment and risk. In this eclectic moment at the beginnings of the modern state, Witt describes American accident law as a contingent set of institutions that might plausibly have developed along a number of historical paths. In turn, he suggests, the making of American accident law is the story of the equally contingent remaking of our accidental republic.

Culture of Accidents: Unexpected Knowledges in Early Modern England by Michael Witmore,
Collapsing buildings, unexpected meetings in the marketplace, monstrous births, encounters with pirates at sea -- these accident experiment and other unforeseen "accidents" at the turn of the seventeenth century in England acquired unprecedented significance in the early modern philosophical accident experiment and cultural imagination. Drawing on intellectual history, cultural criticism, accident experiment and rhetorical theory, this book chronicles the narrative transformation of "accident" from a philosophical dead end to an astonishing occasion for revelation accident experiment and wonder in early modern religious life, dramatic practice, accident experiment and experimental philosophy. Embracing the notion that accident was a concept with both learned accident experiment and popular appeal, the book traces its evolution through Aristotelian, Scholastic, accident experiment and Calvinist thought into a range of early modern texts. It suggests that for many English writers, accidental events raised fundamental questions about the nature of order in the world accident experiment and the way that order should be apprehended. Alongside texts by such canonical figures as Shakespeare accident experiment and Bacon, this study draws on several lesser-known authors of sensational news accounts about accidents that occurred around the turn of the seventeenth century.
